Production-sharing agreement is a form of contracting used in the oil industry. In these agreements, the foreign oil company signs a contract with the government of the host country and takes over the risk of oil operations. If the contractor fails in its endeavors, it must abandon the area and is not eligible for the costs; however, if it succeeds, based on the contract and for the costs and risks he has incurred, it will be entitled to a share called “Cost Oil”. Despite the desirability of this kind of contract in many oil-rich countries, it is not particularly acceptable due to it legal barriers. Accordingly, the article seeks to review the legal status of this agreement in Iran and identify its legal barriers.
